Parents and Children

  • Practice Areas Introduction
  • Appointment of a person with parental rights

In the event the parent who was granted sole rights to the children when getting a divorce passes away, in the past, the rights to children were deemed to be automatically restored to the surviving parent. However, from July, 2013, even a birth parent must be appointed as a person with parental rights by a court. Hankyul assists you with all the procedures necessary for the appointment as a person with parental rights or a guardian of a minor.

Change of family name, family name origin, and name

One’s family name and family name origin cannot, in principle, be changed once determined. However, if there is a good reason, one can change his/her own or his/her child’s family name and family name origin to the family name and family name origin of the father, mother, or a third party with court approval. In addition, the court also permits the change of one’s name when it is deemed necessary. Hankyul provides legal services for the change of family name, family name origin, and name.

    Full Adoption

The full adoption system has been introduced where the adopted child’s relationship with birth parents is completely severed and the adopted child and the adoptive parents’ natural child are treated equally, unlike the adoption system where the child is adopted while the relationship between the adopted child and his/her birth parents remains. Hankyul provides full legal services for the full adoption and dissolution of adoption.

    Establishment of Filiation

There are cases where family relations do not exist in reality even though they are registered as parent and child in the family relations register and where family relations do exist in reality even though they are not registered as parent and child in the family relations register. Hankyul provides legal services for lawsuits seeking confirmation of existence or non-existence of parent-child relationship, required to establish or deny the parent-child relationship, and its recognition procedures.
