  • Implementation of Adult Guardianship System

    From July, 2013, the system for people with limited capacity or people adjudged incompetent will change to the adult guardianship system such as adult guardianship, limited guardianship, and specific guardianship. While the existing law focused on the limitation of the rights of people with limited or impaired capacity, the purpose of the newly instituted adult guardianship system is to reflect the intention of such people and to promote the welfare of such people to the fullest extent possible.

     

    Guardianship Contract

    A guardianship contract has been introduced where a person can entrust the property and personal affairs management to a third party’s care in case such person becomes impaired to manage such matters due to illness, disability, or old age, etc. Therefore, people with impaired capacity now have become able to manage their property and personal affairs according to their own will. The elderly and the disabled are expected to particularly make good use of this guardianship contract.
